The Children’s Online Privacy Protection Act (“COPPA”) requires us to inform parents and legal guardians about how we collect, use, and disclose personal information from children under the age of 13.
Any personal information (for example, name and email) obtained is through an opt-in process both for the blot and the mailing list, with the exception of I.P. information necessary for site improvement or security (see below). We obtain your consent by using a sign up form with a Date of Birth age gate as a required entry field. Please note that although your child can visit this site, he or she cannot directly participate in the blog forum or register on this site.
INFORMATION WE COLLECT FROM CHILDREN AND HOW WE COLLECT IT
We love to hear from children… but only through their parent or legal guardian’s consent and participation. If you would like your children to be able to communicate on this forum or to receive information through our newsletter, you must sign up on their behalf with your own email address, name (or pseudonym) and date of birth. All communication must pass through the parent or legal guardian. Do NOT include any identifying information about your child. Furthermore, any account created directly by a child will be deleted when discovered during our periodic review process.
INFORMATION WE COLLECT ABOUT CHILDREN
NONE. In order to sign up for the Judge Kludge newsletter, a subscriber must enter a date of birth. Periodically, the mailing list will be purged of all subscribers who are younger than 13 years of age. Likewise, in order to become a member of the forum on this website, a participant must be 13 years of age or older.
By signing up for an account and posting information pertaining to your child, or if you allow your child to use your account to post something, you are giving consent for such information to be disseminated. Judge Kludge does not actively track or attempt to link posts to personal identities or locations of children. Any identifying information concerning a child provided by a parent or legal guardian through a public post on this site will indicate parental consent.
All of the social media channels through which Judge Kludge communicates require users to be at least 13 years of age. Therefore, all contact through social media should be made only through a parent or legal guardian.

INFORMATION WE COLLECT PASSIVELY ABOUT SITE USERS
We may passively collect information about yourself or your child. For example, we may collect certain non-personal information from all visitors to our Site, such as IP address; the date and time of visit; time spent on the site; the type of browser used (e.g., Firefox, Internet Explorer); the type of operating system used (e.g., Windows, Mac OS); the ISP from which the visitor receives Internet access; and aggregate information regarding what pages users of the site access or visit. Such information is used to enhance site performance, help with security, and to protect site users from harassment or cyber-bullying. This information may be combined with the personal information we collect from users. Data will be purged periodically. Since we do not collect personal information about children, there is no way to correlate such information with the identity of a specific child.
CONTENT POSTED BY A CHILD
Please note that children can NOT post to this site without posting through an account created by an adult. Therefore, any posts from a child will be assumed to have been allowed by their parent or legal guardian. Parents should closely monitor their children’s use of the Site and what content they post through the parent’s account.
TRACKING ACTIVITIES ON THIS SITE
When a person is logged into his or her account, we track the date and time of “general system interactions” such as updating profile information or password reset requests. This information is associated with your username and helps us follow these types of actions. Once again, children are not allowed to sign up for an account and must pass through a parent or legal guardian to post anything. For your child’s privacy, please do NOT include identifying information about your child in any post.
HOW WE USE YOUR CHILD’S PERSONAL INFORMATION
We do not collect personal information from children. We may use non-personal information such as information about the pages visited to improve the design, content and performance of our Site, or to analyze Site usage and the popularity of certain pages of the Site. This information is not correlated with the specific identity of any child.
You may request information from us on the type of data being collected, and, if you choose, prohibit us from making further use of your child’s information. For more information on how to do this, see the section below entitled “How to Access Information Collected from Your Child.”
HOW WE SHARE PERSONAL INFORMATION WITH THIRD PARTIES
We will not sell, rent or trade your personal information. We may also disclose personally identifiable information in response to legal proceedings – for example, in response to a court order or a subpoena. We may also disclose such information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms or this Policy, or as otherwise required by law. In addition, we may transfer personal information if we are acquired by or merged with another business. No information is collected about children under 13 years of age and thus can not be shared with a third party.
HOW TO ACCESS INFORMATION COLLECTED FROM YOUR CHILD
We implement strict measures to keep from collecting any information about your child. However, if you believe that an anomaly occured through some oversight on our part; a technological mishap; or if your child purposely transgressed our age gate on the mailing list or forum; or if you communicated identifying information about your child, please do not hesitate to contact us. Upon request, we will make sure this information is immediately deleted (see ‘Contact Us’ below).
In the event that information was accidentally obtained, and you would like to know more in order to protect your privacy and security, we will take reasonable steps to verify your identity before providing information. This may include requiring you to provide an official identity card such as a driver’s license or passport.
HOW TO REVOKE CONSENT OR REQUEST DELETION OF YOUR CHILD’S INFORMATION
Once again, we do not collect information about children. However, if such an event occurs through our oversight, or transgression of our age gate on your child’s part, you may revoke consent to collect your child’s personal information at any time, and you may also request to have your child’s personal information deleted and refuse to permit further collection of such information by us.
If you wish to do so, please contact us using the process described in “Contact Us” below. However, please understand that, even after removal, your child’s content may remain viewable in cached and archived pages or by others if a user has copied or stored such content.
We have implemented commercially reasonable safeguards to protect personal information that we collect and store. Despite these precautions, however, no data security safeguards are foolproof. Unauthorized individuals may find ways to obtain personal information from or to access the Site. Please keep in mind that we cannot and do not guarantee that content posted at the Site will not be viewed by unauthorized persons. Any content that you post or allow your child to post is at your own risk.
We reserve the right to update this policy at any time. If a material change is made to the policy, we will email all registered users at the email address provided at time of registration.
TERMS OF SERVICE
We reserve the right to cancel a blog or mail subscription at any time, for any reason. We also reserve the right to ban or block users at our discretion. This blog is a safe haven and negativity is not welcome.
